Artist Sales Agreement • 2026
Hello artists! We’re excited to display and sell your works at Hunchback Gallery in 2026.
Please review the following agreement below carefully before completing the form at the bottom.
1. Introduction
This agreement outlines the terms between Hunchback Gallery and participating Artists regarding the exhibition and sale of original Artwork.
2. Duration
The agreement is active from the time Artwork(s) are delivered until Artwork is sold, picked up by the Artist, or December 31, 2026, whichever comes first.
3. Artist Warranties & Originality
The Artist certifies that they are the sole creator of all submitted Artworks and exclusive owner of the the related copyright. Artist confirms that Artworks are original, do not infringe on the intellectual property rights of any third party, and are free of any liens or encumbrances.
Though Artificial Intelligence may be used as a tool within a broader creative process, the Artist certifies that the final product was created by the Artist and is not an AI-generated work.
The Artist agrees to indemnify and hold Gallery harmless from any claims, artist’s liens, or legal actions resulting from a breach of these warranties, including any disputes regarding the originality or AI-generation of the Artwork.
If Gallery determines that an Artwork violates this AI policy or infringes on another’s copyright, the Gallery reserves the right to remove the Artwork from the exhibition immediately and cancel any pending sales.
4. Display + Exhibition
Artists are responsible for transporting their works safely to and from the Gallery. Hunchback Gallery will display Artwork for the duration of the exhibition period, as detailed in the relevant call for art. Display beyond this period is by Gallery invitation only, and at the Artist’s discretion. Gallery will notify Artists of pickup period as appropriate; unless otherwise coordinated between both parties, Artworks not picked up within 30 days of such notice will become property of the Gallery.
5. Ready-To-Display
Artists agree to deliver their Artworks ready-to-display:
• For 2D/wall-mounted work, this means ready-to-hang (we prefer frame and wire).
• For 3D/sculptural work, artists must provide any supports their work requires in order to display properly and safely for the duration of the exhibit.
• For gift shop display, this includes any kind of caddy, standing display, etc.
6. Promotion
Both Gallery and Artist agree to promote the exhibition through word of mouth, social media, and other marketing channels. Both parties permit the other to include the work or likeness of the other in such promotion and for archival purposes without compensation, and without forfeit of copyrights related to their Artworks.
7. Sales
Gallery will facilitate sales of Artworks at the price identified by the Artist, retaining a 30% commission. The remaining 70% will be paid to the Artist within 30 days of sale.
8. Dispute Resolution
Any disputes will be resolved through mediation.
9. Insurance and Liability
Hunchback Gallery carries general liability insurance for the space and will take all reasonable steps to protect artwork while in its possession.
10. Digital Signatures
Typed names and digital submissions are accepted as signatures for this agreement.
11. Governing Law
This agreement is governed by the laws of the Commonwealth of Massachusetts.
12. Acceptance
By completing and submitting the form below, the Artist acknowledges that they have read, understood, and agreed to the terms of this agreement.
